It is also the highest flat annual rate we found for this job in South Dakota.

South Dakota Will Accept a Job Title on That Line

Here is something almost nobody selling agent service will mention, and it is worth knowing before you compare two invoices.

Your entity cannot write its own name on the agent line. What SDCL 59-11-6(2)(b) permits instead is writing a description of a job there: the title of an office or a position inside the company, with service of process routed to whoever holds that title on the day the papers arrive. Framed that way, the record describes a duty rather than naming a human being, and the duty stays occupied when the person occupying it resigns.

South Dakota charges nothing for that arrangement. It bills you in a different currency. The designation still has to carry an actual street address, or a rural route box, physically located in South Dakota and readable by anyone who pulls your entity up in the state business search. A PO box on its own is refused. Somebody has to be at that address through ordinary business hours, awake and willing to accept an envelope from a stranger, because a locked door does not postpone service. It only makes the visit unpleasant.

That requirement is why South Dakota's formation scene runs on agents. Owners who live somewhere else hold a sizeable portion of the LLCs sitting on file here, pulled in by a jurisdiction that levies no income tax and keeps thin public records. Those owners cannot designate a position inside their own company, because the position would have to sit somewhere in South Dakota and there is nowhere in South Dakota for it to sit. If you run a counter in Rapid City that is staffed all day, the free route is genuinely open to you and we would rather say so than let you find out later.
